Last Laugh Comedy Club - Show producer Agreement

This Performance Agreement (the "Agreement") is entered into as of the date of the show, by and between Last Laugh Comedy Club (the "Club") and the Producer(s) of the show (the "Producer").

Contractual Agreement

By producing a show at Last Laugh Comedy Club, the producer automatically enters into this contract.

Show REQUIREMENTS

  • The Club provides a lighting & sound technician for a price of $30 per hour.

    • For any technical show requirements, please make sure you provide at least 5 working days notice to the Club so that the club may schedule a time with the technician to go through any specific show requirements.

    • Please be advised that technical show requirements will incur a cost for the Lighting/Sound Technician's time.
       

  • An allocation of 30 minutes will be given to the Producer before the show to run through any tech requirements. 
     

  • The Club has access to 1 50 inch Smart TV that can be controlled through a HDMI connection or wirelessly through Apple Screen Mirroring and AirPlay (Mac) or Windows equivalents (like AirServer, Reflector, 5KPlayer, and TuneBlade).

    The Producer is responsible for sending over any files such as powerpoint presentation 48 hours in advance of the show. 

     

  • The Club has access to two Shure SM58 Microphones, one at the stage with a length of 4m and one at the Lighting/Sound desk with a .5m length. We do not currently have a two microphone option for the stage.

    The Producer is welcome to bring their own wireless microphone(s) as long as they provide notice to the Club and the technician.

Compensation

  • Use of the space

    • There is no charge for using the space at Last Laugh Comedy Club for the production of the show.

    • 100% of the net profit from ticket sales is paid to the Producer of the show

    • The Producer of the show is responsible for paying any acts that perform during the show

    • Net profit refers to the total amount after expenses e.g. transaction fees, cost of light/sound technician, cost of marketing.

    • The Producer acknowledges that the bar must make at least $300 in sales during the event.

    • If the bar sales do not meet the $300 minimum, the Producer will be invoiced for the difference.

  • Ticketing

    • The Producer can choose to run their own ticket sales through their preferred platform or run ticket sales through the clubs website.

    • The Club manages its ticket sales through its online ticket portal. All ticket sales are subject to a 1.5% transaction fee that is paid to the Clubs payment partner Stripe. ​

Marketing

  • As a standard the Club will offer the following marketing support:

    • Organic social media posts

    • Organic Facebook/Instagram stories

    • A listing on the Club's homepage & events pages

  • The Club offers a paid Marketing Pack to assist in promoting the show for a fee of $200. The Marketing Pack includes:

    • Social media promotion on the Club’s platforms

    • A paid Facebook advert with the promotional material for the show

    • Inclusion in the Club’s email newsletter
       

  • The Club does not offer any graphic design, postering or flyer support.
     

  • The Producer must notify the Club at least 3 weeks in advance if they wish to purchase the Marketing Pack.

PROMOTION & DIGITAL ASSETS

  • The Producer is responsible for promoting their show in addition to any marketing support provided by the Club.

  • The Club will provide logos and digital assets to the Producer for use in promotional materials.

BAR SALES & INVOICING

  • The Club will provide the Producer with a report of bar sales within 48 hours after the show.

  • If bar sales are less than $300, the Producer agrees to pay the difference.

  • The Club will invoice the Producer for the amount needed to reach $300, and payment is due within 14 days of the invoice date.

Cancellation policy

  • If the Producer needs to cancel the show for any reason, they must provide 72 hours notice to the Club. If notice is not provided, the Producer agrees to pay the $300 bar fee. 

  • If the Club needs to cancel the show, they must provide 72 hours notice to the Producer.

  • In the event that the Club cannot host the Producers show due to an issue with licensing, legality, foreclosure or an act of god, the Club reserves the right to cancel the show without notice.

Expected Conduct and Behavior

  • The Producer agrees to maintain a professional demeanor at all times while at the Club.

  • The Producer will ensure that all performers and staff associated with the show adhere to the Club’s policies and guidelines.

  • The Producer will not engage in any behavior that could be considered offensive, discriminatory, or harmful to any audience members, staff, or performers.

LIABILITY

  • The Producer acknowledges that they are responsible for any damage caused to the Club's property during the production of the show.

  • The Club is not liable for any injury or damage that occurs during the show.

Miscellaneous

  • This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements, whether written or oral.

  • Any amendments to this Agreement must be made in writing and signed by both parties.

  • This Agreement is governed by the laws of Aotearoa New Zealand.
